2- Products

Each article on the site is described and photographed. The photographs and texts inscribed are not contractual. The dimensions of the products are given as an indication so that the buyer can get an overall idea of the final dimensions of the product. If this item is very important to the buyer, it is his responsibility to contact the store to request verification before any validation of order. The size/weight data is given as an indication by the manufacturers and is transmitted on this site as such. If an error appears on a product listing, we are committed to correcting it as soon as possible, so please contact us through our contact form. All items on the site are available as limited to available stocks. 3- Prices

Prices on the website and in the shop are shown in Euros , including all taxes. They are applicable when the order is validated by the consumer and do not include participation in shipping costs, which will be charged extra and indicated during the final phase of the order and before validation, excluding mention or special conditions.

Prices are subject to French VAT and any change in the legal rate of vat will be implicitly passed on to the price of products presented on the website, on the date stipulated by the implementing decree referring to it. Products will be charged on the basis of the rates in effect at the time of order registration. The products remain the property of AVATAR SAS until the full payment of the price set at the time of the validation of the order.

4- Registering a new customer

On the first order, the customer must register on the website. When registering, it certifies that the data it enters is real and true. Any misrepresentation or misrepresentation and/or incomplete statement will be considered null and void and will result in the deletion of the account. 6- Order and regulations

Any order is worth accepting prices and descriptions of the products available for sale.

All orders are effective as soon as the settlement is received.

All orders are payable in Euros.

The payment of the entire price of the order must be made when it is validated by the buyer. At no time can the sums paid be considered as deposits or instalments.

The order will only be shipped upon receipt of the order number payment generated by the website. For pre-orders, orders will be shipped once payments and products have been received and in order of arrival. In the event that the customer orders a pre-order item with other items, the order will only be shipped once complete. If the customer wishes to receive the available items, he will have to pay the shipping fee.

AVATAR SAS reserves the right to suspend or cancel any order and/or delivery, regardless of their nature and level of execution, in the event of non-payment of any sum that is due by the buyer, or in the event of a payment incident, and to suspend any new order in the event of a late payment on a previous order.

7- Delivery and fares

The products will be delivered to the address indicated by the buyer on the purchase order subject to payment of the postage (excluding free). The buyer can request a delivery to a different address from the order's billing address.

The majority of orders are delivered to the chosen carrier within 24 hours to 72 hours (working days) following receipt of payment, with the exception of orders for which a product may be missing or which would require restocking. It is then routed within the legal timeframe communicated by the carrier (this may be a little longer on the summer period or on public holidays).  The seller cannot be held responsible for any delay in delivery.

In the event of a delay in delivery from the original date (one week from the order date), the buyer will be able to report it in writing (mail or mail) to AVATAR SAS, in order to improve the quality of service that may be offered to him and to allow the seller to carry out an investigation with the carrier.

The buyer is required to check, in the presence of the carrier, the condition of the package, the goods and their contents on delivery. In the event that the buyer has any doubt of any kind about the condition or contents of his package, he is obliged to refuse the goods by immediately issuing a report of anomaly with the carrier and to report the incident to the company AVATAR SAS, by e-mail within 24 hours of the delivery date of the parcel, and this by exposing the so-called claims or reservations. The buyer will have to send in this email the maximum information: order number, carrier, references and quantity of damaged items, photos of the goods ( In the absence of compliance with the procedure outlined above, no buyer's claim will be accepted.

In the event of delivery of a product that does not correspond to the order (defective or non-compliant), the buyer must make his claim within 24 hours of the delivery date of the order. Complaints must be made by email or using our contact form and must include the buyer's contact information, the number of the invoice concerned, the product references and the reason for the claim. The products must be returned by the buyer within 14 working days from the date of delivery and after the seller's acceptance, in their original packaging and in a perfect state of resale - port charges back at the buyer's expense.

8- Return of goods

Any return of goods following an error by the buyer is subject to our express written permission. It will be mandatory in paid port, no port due will be accepted. In case of return product, the return transport costs will be borne exclusively by the customer.

In the event of a return of defective products and a request for a refund, this will be done within one month after the return of the defective product.

In the event of the return of unwanted products, in order to obtain an exchange with a new product, the shipping costs of the new product will be borne by the buyer. If the product is not suitable for the buyer (excluding defective products) and wishes to return it after opening it, no refund will be made but a credit can be triggered. On the other hand, the cost of transport back will be borne by the customer.

9- Right of withdrawal

In accordance with Article L121-20 of the Consumer Code, the Buyer has seven working days from the date of receipt, to return at his own expense and at his peril, the products ordered, for exchange or refund. Products must be returned in their original packaging and in perfect resale condition at:

In case of return product, the return transport costs will be at the customer's expense.

At the end of the seven-day contract period, the products delivered are deemed to be compliant with the order and therefore accepted by the customer. No refund will then be possible under the right of withdrawal.

10- Protection of personal data

The information of the personal information collected in connection with the distance sale is mandatory, this information is necessary for the processing and delivery of orders as well as for the establishment of invoices. This information is strictly confidential and is intended only for AVATAR SAS.

The customer has the right to access, modify and delete the data that concerns him (Article.34 of the law "computers and freedoms"). 

11- Responsability

AVATAR SAS has, for all stages of access to the site, the ordering process, delivery or later services, only a means obligation. AVATAR SAS cannot be held liable for the inconvenience or damage inherent in the use of the Internet network, including a breakdown of service, an external intrusion or the presence of computer viruses, or in fact classified as force majeure, in accordance with the case law. In addition, AVATAR SAS is liable for any breach of its contractual obligations in the event of a force majeure or fortuitous force, including without this list being exhaustive internal or external strike, including postal and transport services and/or communications, fire, disaster, internal or external failure, and in general any event that does not allow the proper execution of orders.

12- Litigation

These terms and conditions of sale are governed by French law. In the event of a dispute that cannot result in an out-of-court settlement, only the courts of Pointe-à-Pitre in Guadeloupe will have jurisdiction.
